Excellent!!!! May other states follow suit. Other groups have been paid reparations but not blacks after 346 years of exclusions and continued discriminatory practices based on race.

    California Puts a Price on Slavery’s Legacy and Draws a Blueprint for ReparationsBy one reckoning, the state’s payments could reach $1.2 million per person. But who is compensated, and by whom, is far from resolved.The numbers are striking in their precision. The statistical value of each year of human life, accounting for racial differences in life expectancy: $13,619. Wealth missing due to lower rates of Black home ownership: $148,099. Average devaluation of Black-owned businesses: $77,000. Each year of disproportionate incarceration factored by race, combining lost wages and freedom: $159,792.These calculations by California’s Task Force to Study and Develop Reparation Proposals for African Americans, buried in the nearly 500-page draft of a report that will go to the state legislature in late June, belie the complexity and raw emotion underlying the first state-level effort to provide compensation for the legacy of slavery and discrimination in the US. By even considering reparations for harms that have compounded for centuries, California is transforming what has been a largely theoretical concept into a detailed model that may be adopted elsewhere as others also attempt to reckon with the costs of historical injustices.     From the Brennan Center for Justice:Donald Trump has made clear that, in a second term, he would govern differently than any president in U.S. history. He has hinted at suspending the Constitution, building vast deportation camps, weaponizing the Department of Justice, and mass firing career civil servants.Here’s one you might have missed: he reportedly plans to invoke the Insurrection Act, which allows the president to use the military as a domestic police force, on his first day in office.In 2020, of course, Trump himself engineered a shambolic insurrection. This time, the thought goes, if he is displeased by protests, he will use the law as a way to crack down and grab more power. Think of the “Reichstag moment” reportedly feared by General Mark Milley three years ago.Much like the Electoral Count Act — a similarly archaic and poorly drafted law that Trump attempted to exploit — the Insurrection Act was written for a different time and urgently needs reform, as my colleague Joseph Nunn writes.There’s some deep history to be aware of. In the 19th century, the military was used domestically to a wide variety of ends: to persecute Native American tribes on the frontier and capture fugitive slaves, but also to ensure Black men could vote and crush the Ku Klux Klan. It has a complicated record during a complicated century.Congress intervened in 1878, prohibiting the president from using federal troops to enforce civilian law under most circ*mstances. The Insurrection Act, which dates all the way back to 1792, was maintained as an exception to this prohibition.The law is a model of how not to draft major legislation. Key terms like “insurrection” and “rebellion” are left undefined. The language is so outdated that no modern American can be sure of its meaning. The few times the law was reformed, it was changed to give the president more power rather than less. And courts have interpreted it to grant the president exclusive and unreviewable authority to decide whether the conditions to deploy the military have been met.There’s a complete absence of checks and balances. As a result, we rely on the wisdom and good faith of a single person to uphold the important wall between military action and domestic policing.Trump reportedly considered activating the Insurrection Act twice during his presidency — first to quell Black Lives Matter protests and later to hold on to power after his election defeat.The Brennan Center has proposed important reforms to the Insurrection Act. Congress should define the law’s critical terms. Legislators and judges must play a larger role in overseeing the president’s exercise of the law. There’s nothing remotely partisan about these changes — they’re common sense. Congress can and should adopt them today.

    Searching for epistemic reality in the multi-verse

    In overturning Roe V Wade the majority opinion was based on a paradigm associated with originality (the constitution must be interpreted in its original intent); however, the United States Constitution was originally proslavery in its foundation as a result of the compromises that were made to pacify the slave states and ensure that there was a constitution acceptable to all the states. In part, this was done to ensure that the original thirteen states would unite and not dissolve into regional coalitions. Proslavery features such as a fugitive clause requiring the return of escaped bonds people and a postponement of the end of the slave trade was included. In addition, to give the slave states power there was the 3/5thclause which acknowledged slave people, not as people, but as property that could be counted for the purpose of determining representation in the electoral college and congress. This gave the slave states significantly enhanced power in all three branches of power. As a consequence, the original constitution seemed to from the foundation for the United States to be a proslavery country and have a proslavery future. With the overturning of Roe V Wade, with the justification of originality, it would seem that we are returning to our “original’ roots of proslavery, as the supreme court begins the journey by taking away some of the rights of one segment of the population: woman.#supremecourt #roevwade #future #rights

    Red states are becoming more fascist, more anocracies rather than democracies, as the Republicans who control those states seek ways to stay in power and give voters less and less to say about how their state is governed. Here is the latest from North Carolina. If you live in that state you will now have a “secret police” controlled by a Republican-dominated committee.

    From Laurence Tribe: “The American legal system doesn’t uphold the values of democratic rule like equality. It far more often corrupts and perverts them. Rich people like Trump twist the system into a pretzel and win delay after delay after delay. Corporations pay fines, usually not that large when considered against their bottom line, and they admit no wrongdoing, even after their practices have killed people. Poor people, meanwhile, get pushed around by the system constantly.There is no such thing in this country as equality before the law, and everyone knows it. And I would argue that this legal inequality does more damage to democracy than all the political inequities for the simple reason that they’re more visible. And they’ve never been more visible than they are now with Trump. If he is able to push all these cases back past November, or at least three of them (the Bragg case should proceed this summer), and then especially if he wins the White House and pardons himself, that will constitute the biggest failure of the rule of law in the history of the country.“https://lnkd.in/gPPacY3F

    Increasingly as I have watched Red state Republicans try to turn their states into christofascist anocracies I have been following how they seek to castrate the political power of their Blue cities. It has become a very pronounced trend, and nowhere is the trend clearer than in Texas. Day-by-day we are becoming two countries.

    From time to time I hear from potential clients that they are afraid to invest because of the crazy times we are in. Many times this has to do with the political landscape. I tell them that US politics has always been messy and crazy. I have included some examples you may remember, the others you will have to check the history book. During the mid-1960s through the mid-1970s the country was divided over civil rights. Remember in 1965 when Watts went up in flames? Or in the 1970s when the national guard killed four students at Kent State? This led to protests at 350 campuses, involving an estimated two million people. Also, you can’t forget when Thirty-five thousand antiwar protesters assaulted the Pentagon in October 1967. The early 70’s was a crazy period to say the least as the U.S. experienced more than 2,500 domestic bombings in 18 months from 1971-72. Going back further, will require the history book but in 1888 Republicans won the White House, held the Senate and held the House but just by four people. During a floor vote if more than four Republicans were missing, House Democrats would demand a roll call and refuse to answer when their names were called. The measure would fail because there was the lack of a quorum. This kept the House from acting for months. In 1838 Whig William Graves of Kentucky shot and killed Democratic Rep Jonathan Cilley of Maine in a duel over charges of corruption. In 1824 Andrew Jackson led the four way presidential race with 41% of the popular vote and carried 11 states but with 99 electoral votes came up 33 short of a majority. The contest went to the house where each delegate had one vote and they seated John Quincy Adams even though he was the runner up with 84 electoral votes. For the next four years, Andrew Jackson condemned the corrupt process and said it deprived the people of their right to a free election. In the next presidential election in 1828, Andrew Jackson defeated John Quincy Adams. These are just some examples of the craziness our country has been through. Unfortunately, crazy times will continue but ultimately good businesses will continue to survive and thrive.
